On August 1, 2025, Delaware officially launched legal adult-use cannabis sales. Adults aged 21 and over can now legally purchase recreational cannabis products from 12 licensed retail dispensaries across the state, marking a major step forward in Delaware’s cannabis legalization efforts.
This long-awaited development opens a new chapter in Delaware’s cannabis policy. Consumers may now legally purchase various forms of cannabis products, including buds, gummies and other edibles, vapes, capsules and tinctures.
Although sales have begun, strict purchase and possession limits remain in effect. Individuals may not purchase or possess more than one ounce of cannabis, including flower and other leaf-based marijuana. Possessing more than one ounce is classified as a misdemeanor, punishable by up to three months in prison and a fine of up to $500. Consumers may make multiple purchases, but any amount exceeding the legal limit must be given away without compensation.
Under Delaware law, smoking cannabis in public is strictly prohibited. Additionally, because cannabis remains illegal at the federal level, transporting it across state lines is still against the law.
A number of the state’s existing medical marijuana “compassion centers” are leading the initial phase of adult-use cannabis sales. These centers have successfully transitioned into dual-use facilities serving both medical and adult-use consumers. This transition represents a critical first step in Delaware’s phased implementation of a regulated cannabis program, which emphasizes public safety, equity, regulatory compliance, and health.
“The launch of adult-use cannabis sales by Delaware’s existing medical operators marks an important milestone in Delaware’s rollout of its regulated cannabis market,” said Joshua Sanderlin, “Thank you to everyone who has worked so hard to bring this moment to fruition. We will continue to work to bring additional licensees on line in the months to come.”
Under the legal framework established by the Office of the Marijuana Commissioner (OMC) and Delaware’s Marijuana Control Act, medical cannabis compassion centers that have received conversion licenses are now authorized to conduct adult-use cannabis sales. As the adult-use market continues to roll out, more licensed entities—including cultivators, product manufacturers, retail facilities, and testing laboratories—are expected to begin operations. In this dual-market system, new licensees will serve both adult-use and medical cannabis consumers.
The landmark legislation passed by Delaware in 2023 not only legalized adult-use cannabis but also established a regulatory structure that places strong emphasis on public health, social equity, and accountability. After extensive public consultation, the OMC released a comprehensive set of regulations in September 2024.
The issuance of conversion licenses provided a vital jumpstart to the market, enabling the state to launch adult-use sales rapidly through existing retail channels. Additionally, the initiative generated $4 million in grant funding to support social equity licensees. In 2024, the OMC received over 1,200 license applications and awarded 125 licenses through a public lottery held in December. The OMC continues to issue conditional and active licenses to lottery winners as background checks are completed and final inspections are passed.
“OMC worked closely with medical marijuana operators to ensure that the transition to adult-use was smooth,”said Deputy Commissioner Paul Hyland, “Their ability to convert licenses was instrumental in speeding up this launch. We will continue to work on expanding access responsibly as more licensees come aboard in the months ahead.”
Consumers are reminded that only purchases made from licensed retailers are legal and regulated under Delaware state law.
